Do you ever face in situations where you have monetary dispute with an individual to claim back a small amount and you don’t feel like appointing a lawyer to claim back the money?
Do you know that you can actually initiate your own legal proceeding?
By virtue of Order 93 of the Rules of Court 2012, Small Claim Procedure.
You just have to write in form 198 under the Rules of Court 2012 and file it to the Registrar of the Magistrate Court.
The Registrar will seal form 198 and after that you serve the form198 to the person you are claiming the money with.
Your opponent may file 199 for the defense of their claim.
If the opponent fails, refuse and/or neglect to fill in form 199. Then you may proceed to File form 201 to get Judgment against the person you are claiming the money with.
However, do take note that Order 93 Small Claim Procedure is only for monetary dispute which are RM5,000 or lower.
