What do you do when you get arrested besides getting panicky? Here are some of the things that you should know if it ever happens to you!
1. Ask for the Police identity if s/he is not in uniform. Note his name and his authority card number.
Note: If his ID is red in colour, he is a suspended Police Officer, in which he has no authority to do anything to you.
2. Only give your name, I/C number and address. And ask if you are under arrest.
The answer is affirmative if: he says ‘Yes’ or if he does not allow you to leave or if you have been handcuffed.
3. Remember, the Police cannot arrest you just because you are a potential witness and they want to take a statement from you.
4. It is unlawful to arrest you without being told of the reason. However, if you resist, the Police has the right to use reasonable force against you.
5. If you are brought to the nearest police station, you can make a phone call to your relative or your lawyer.
6. The Police Officer can only detain you for up to 24 hours for investigation. If he cannot do so within 24 hours, you must be brought to the Magistrate Court for a remand order to extend your detention beyond 24 hours.
7. Do not feel obliged to answer any questions unless if they concern your personal details. Be polite. You have the right to remain silent.
