Stamp Duty Formula For Tenancy Agreement In Malaysia

Step 1: Calculate your total of annual rental

(e.g.: RM2,200 per month x 12 months = RM26,400)

 

Step 2: Calculate your taxable rental

The first RM2,400 of your annual rental is exempted for stamp duty. So, you will minus RM2,400 from your annual rental.

(e.g.: RM26,400 – RM2,400 = RM24,000)

 

Step 3: For every RM250 or part thereof, different rates will apply depending on tenancy period:-

Continue from the example above,

If your tenancy period    = 1 year
Payable Stamp Duty       = (RM24,000 / RM250) x RM1
= 96 x RM1

= RM96

 

If your tenancy Period    = 2 years
Payable Stamp Duty       = (RM24,000 / RM250) x RM2

= 96 x RM2
= RM192

 

If your tenancy Period    = 3 years
Payable Stamp Duty       = (RM24,000 / RM250) x RM4

= 96 x RM4
= RM384

 

Step 4: For second copy of tenancy agreement, the stamping cost is RM10.

Total Cost = Stamp Duty + RM 10 Stamping for 2nd copy
